What is Personal Information and why do we collect it?

Personal Information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. Examples of Personal Information we collect include: names, addresses, email addresses, phone numbers, business and employment details and responses you provide through our online tools and questionnaires.

When we conduct file reviews and other advice quality services for our clients, we also handle Personal Information contained in advice files. This may include information about financial advisers (such as their name, authorised representative number and the advice they have provided) and information about the advisers’ own clients (such as their personal and financial details).

We collect Personal Information in a number of ways, including by correspondence, telephone and email, through our website www.tangeloconsulting.com.au (including our online assessment tools, calculators and cookies), from publicly available sources, such as your website, media and publications and from third parties such as our clients when we provide advice quality review services. We don’t guarantee website links or policies of authorised third parties.

Where reasonable and practicable, we collect Personal Information directly from you. When a licensee or advice practice engages us to review advice files, they provide us with information about their advisers and their advisers’ clients. In these cases we take reasonable steps to ensure you are made aware of this, which may include relying on our client to notify you.

We collect your Personal Information for the primary purpose of providing our services to you, and our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing and marketing lists at any time by using the unsubscribe link in our emails or by contacting us.

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

Sensitive Information

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.

Advice files we review as part of our advice quality review services may contain sensitive information about the clients of the advisers whose files we review, such as health information relevant to insurance advice. We handle this information only as needed to complete the review.

Sensitive information will be used by us only:

  • for the primary purpose for which it was obtained;

  • for a secondary purpose that is directly related to the primary purpose;

  • with your consent; or

  • where required or authorised by law.

Disclosure of Personal Information

We may disclose your Personal Information:

  • where you consent to the use or disclosure;

  • to the licensee or advice practice that engaged us;

  • to our service providers, such as IT, cloud storage and AI tool providers, who help us deliver our services; and

  • where required or authorised by law.

Disclosure of Personal Information outside Australia

Some of our software service providers, including providers of artificial intelligence (AI) tools we use in our work, are located outside Australia and may store or process data in the USA.

We only deal with reputable software service providers and will take reasonable steps to ensure that any overseas recipient will deal with such Personal Information in a way that is consistent with the Australian Privacy Principles.

Use of Artificial Intelligence

We use AI tools to support our work, including to assist with researching topics, drafting content and developing tools and templates used in delivering our services.

All AI-assisted outputs are reviewed, verified and approved by a member of our team before they are used or provided to clients. AI tools do not replace the professional judgement of our consultants and responsibility for our advice and services always rests with our people.

Where it is necessary to use Personal Information with an AI tool, we limit the information to what is reasonably required for the task and where applicable, de-identify it first. We only use AI tools from reputable providers that do not use the information we enter to train their AI models.

We review the AI tools we use from time to time to make sure they continue to meet our privacy and security standards.

Online Assessment Tools and Calculators

When you use our Advice Business health check or Fit2Merge self-assessment tools, we may collect the information you enter, which may include your name, email address, business details and your responses. These tools provide general results only and do not make decisions about you. Any advice we provide following an assessment comes from our consultants, not the tool. We use the information you provide through these tools to follow up with you about our services and for marketing, as described in this policy.

The Tax Deductibility Calculator provides estimates only of how much of the cost of financial advice may be claimable as a tax deduction. The results are estimates only. It is not tax advice and does not determine anyone’s tax position. Advisers and licensees who use the calculator must apply their own professional judgement to confirm the figures are correct for their client.

Automated Decision Making

We do not use computer programs, including AI tools, to make decisions, or to do things substantially and directly related to making decisions, that could reasonably be expected to significantly affect the rights or interests of an individual.

When a licensee or advice practice engages us to review advice files, our consultants use a checklist to record their own assessment of each file. The checklist does not calculate a score or rating. All findings and recommendations are made by our consultants using their professional judgement, and the licensee or advice practice decides what action to take in response.

Security of Personal Information

Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.

When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify it. However, information held in client files is kept for a minimum of 7 years.

Access to and Correction of your Personal Information

You may access the Personal Information we hold about you and update or correct it, subject to certain exceptions. If you wish to access or correct your Personal Information, please contact us in writing. We will not charge a fee for your access request and will generally respond within 30 days. If we refuse your request, we will tell you why.

If you think the information we hold about you is inaccurate, out of date or incomplete, please let us know so we can correct it.

To protect your Personal Information, we may require identification from you before releasing the requested information.

Policy Updates

This policy may change from time to time, including as our use of technology changes. The current version is always available on our website.

Complaints and Enquiries

If you have any queries or complaints about this Privacy Policy, how we handle your Personal Information, or our use of AI or automated decision making, please contact us.

We will acknowledge your complaint and aim to respond within 30 days. If you are not satisfied with our response, you may lodge a complaint with the OIAC.
